In a stunning decision, the 9th Circuit Court of Appeals has ruled that Idaho can ban transgender students from using bathrooms that align with their gender identity. The ruling prioritizes cisgender students’ “privacy concerns” over the harm faced by transgender students, effectively stripping them of Title IX protections in school facilities. It also contradicts recent precedent from both the 9th Circuit and other federal courts that have affirmed equal protection rights for transgender people. Even under heightened scrutiny, the court determined that transgender students could legally be excluded from bathrooms corresponding to their gender identity due to unspecified harm they may be hypothesized to cause cisgender students. In multiple instances, the decision also treats transgender students as their assigned sex at birth, setting a dangerous legal precedent with implications far beyond Idaho.

The court ruled that a “privacy interest” in excluding transgender students from bathrooms outweighs their equal protection rights. It stated that “not exposing students to the unclothed bodies of students of the opposite sex, and protecting students from having to expose their own unclothed bodies to students of the opposite sex” justifies barring transgender students from locker rooms, changing rooms, and bathrooms. It also stated that a person’s sex is “typically identified at birth” and treats “biological sex” as “sex assigned at birth” without justification. In doing so, the ruling explicitly categorizes transgender youth as the “opposite sex” in legal terms, setting a precedent that could further erode their protections under federal law

So easy to turn to Hitler and Adolph Netanyahu in 100 days....

FBI director Kash Patel’s promise of the “world’s largest manhunt” isn’t just targeting the so-called “Deep State” of federal officialdom he blames for persecuting Donald Trump. Nor is it only pursuing foreigners, like student visa and green card holders, or those without legal status. The manhunt, events this week make clear, is also targeted at the American people.

Unlike the post-9/11 Global War on Terrorism (called GWOT), this new Domestic War on Terrorism (let’s call it DWOT) doesn’t bother to link criminal acts to officially designated foreign terrorist organizations. Trump’s DWOT is actually a war on American citizens, and one that reaches into the nation’s universities and into cities and towns across America.

This new War on Domestic Terrorism is nakedly partisan, every bit as politically motivated and vindictive as what Trump has accused Joe Biden and Barack Obama of. But there’s one crucial difference. Trump’s targets are no longer Washington bigwigs. They’re Americans whose names you’ve never heard before.

This point is crucial: The US vice president has admitted that Washington's goal is to keep formerly colonized countries in the Global South trapped at the bottom of the global value chain.

The US-led West wants to maintain a strict international division of labor, in which poor countries in the periphery produce low value-added goods (with lots of competition and therefore low profits), whereas the rich nations in the core extract exorbitant monopoly rents through their control over high value-added technologies (with little to no competition, reinforced by strict intellectual property rights).

China has tried to challenge its subservient place in the world-system, to move out of the periphery -- so the US government has responded with aggressive tariffs, sanctions, and export controls, aimed at sabotaging China's technological innovation and economic development, to keep the US at the top of the global value chain, where it can continue to extract monopoly rents.

In other words, JD/VD Vance has inadvertently acknowledged that the fundamental thesis of the dependency theorists in the 1950s and '60s was indeed correct!

Another win for dependency theory.
